Appeals Court Reverses Las Cruces Man's Conviction In Daughter's Death

 A New Mexico appeals court has overturned the convictions of a Las Cruces man sentenced in the death of his baby daughter.

The New Mexico Court of Appeals found Robert Flores' right to a speedy trial was violated.

In an opinion filed Wednesday, the court says the 3rd Judicial District Attorney's Office negligently delayed Flores' case between 2007 and 2012.

Flores was sentenced in 2013 to 18 years in prison for reckless child abuse resulting in death and evidence tampering.

Prosecutors say Flores left 4-month-old Kalynne in a laundry basket in December 2007 and then went drinking.

She was later found dead. A medical examiner ruled the cause of death as asphyxia.

District Attorney Mark D'Antonio says he is extremely disappointed by the ruling.
