The lawyer for an Albuquerque police officer charged with murder in the death of a homeless man says there is "not one shred" of evidence to support the case.
Sam Bregman says the district attorney has no basis to file a murder charge against former Detective Keith Sandy. He says the officer had absolutely no criminal intent when he encountered the knife-wielding homeless man who had a long history of violent encounters with authorities.
Bergman says the officer followed training procedures outlined by the police department.
The attorney says Sandy likely saved the life of a police dog handler who was a several feet away from James Boyd, opening fire after Boyd stepped toward the officer who didn't have his gun drawn.
The U.S. Justice Department has issued a harsh report about the police agency's use of force.
