Carlsbad Mental Health Center Official Facing Fraud Charges

A former Carlsbad Mental Health Center administrator will now facing charges of Medicaid fraud in district court.

The Carlsbad Current-Argus reports the case against John Bain, former chief operations officer at CMH, was moved over to district court Thursday. Bain faces several fraud charges, including Medicaid fraud and falsification of documents.

Bain's attorney had asked for the case to be dismissed, citing a lack of evidence that Bain knew about his staff's double billing practices. But the judge said supervisors have to be held responsible.

Cases against three other former CMH administrators related to Medicaid fraud remain open pending scheduling for a preliminary hearing.

Charges have also been filed against the now-defunct mental health center for the same illegal double billing practices.
