Drunk Driver Charged With Killing Best Friend

  Las Cruces—Estevan Herrera was indicted on January 29, 2014 on 8 counts which included, Homicide by Vehicle (Driving While Under the Influence) Homicide by Vehicle (Reckless), Leaving the Scene of an Accident (Great Bodily Harm or Death), Aggravated Driving While Under the Influence of Intoxicating Liquor or Drugs, Reckless Driving, No Seat Belts, Negligent Use of a Deadly Weapon (Intoxication), Failure to Give Information and Render Aid, Failure to Give Immediate Notice of Accidents.

On October 24, 2014 Herrera was driving on Hwy 28 at a high rate of speed with his best friend Patrick Nieto as a passenger.  Herrera ran a stop sign and wrecked into a light pole, breaking it in half and ultimately causing Nieto to be ejected from the vehicle.  The defendant tried to move the victim and leave the scene realizing law enforcement would be en route.  Herrera left the crash site but later returned with his mother. 

Herrera failed to call 911 nor did he render aid to Nieto.

Herrera’s blood sample contained a .23 alcohol level.

Bond was set at $20,000 secured.
