Former Sheriff's Request For New Trial, Sentencing Delay

A federal judge has scheduled a hearing on a former northern New Mexico sheriff's requests for a delay in his sentencing while he seeks a new trial in a road rage case.

U.S. District Judge James O. Browning scheduled the hearing Tuesday in Albuquerque on both of the requests by lawyers for former Rio Arriba County Sheriff Tommy Rodella.

Rodella is scheduled to be sentenced Wednesday on his Sept. 26 convictions for brandishing a firearm and depriving a motorist of his rights during a March incident.

Federal prosecutors oppose both defense requests.

Rodella faces a mandatory seven years in prison on the firearm count and up to 10 additional years on the civil rights count.
