A judge in Alamogordo has ruled that an 18-year-old woman is mentally incompetent to stand trial in the smothering death of her foster mother.
The woman was charged with first-degree murder and other crimes in the 2011 death of Evelyn Miranda of San Patricio.
The Alamogordo Daily News reports that District Court Judge James Counts ruled Tuesday that the 18-year-old probably won't become competent in the near future.
Counts ruled that she could be a danger to others. He ordered that she remain in custody pending action by health authorities.
The Associated Press is not using the name of the woman, who was 15 years old when charged.
Co-defendant Alexis Shields pleaded guilty in 2013 to first-degree murder. She was sentenced to roughly 10 years in prison.
