A federal judge is refusing to release a Deming man and his son from jail before they are sentenced for making false statements during a 2011 firearms sting at their gun store.
U.S. District Judge Robert C. Brack turned away requests by lawyers for 57-year-old Rick Reese and his 25-year-old son Ryin Reese on Tuesday.
Both Reeses were acquitted of the most serious charges they faced during a trial in August.
A spokeswoman for the U.S. attorney's office tells the Las Cruces Sun-News sentencing for the Reeses has yet to be scheduled. Judge Brack will consider the Reeses' motion for a new trial in January.
The U.S. attorney's office says the Reeses face up to five years in prison.
