Las Cruces Man Indicted for Vehicular Homicide

  LAS CRUCES, N.M. – Today, District Attorney Mark D’Antonio announced that a grand jury has indicted a Las Cruces man accused of causing a fatal car accident while driving drunk.  

Adam Spaulding, now 24, is charged with one count of homicide by vehicle, a third-degree felony. He is also charged with aggravated driving under the influence, reckless driving, driving without a seat belt and driving without insurance, all misdemeanors. 

According to investigators, the crash happened on Feb. 28 on Interstate 25 in Las Cruces. The defendant was driving back from El Paso with his 24-year-old sister when he struck a concrete barrier on the interstate. His sister died from injuries sustained in the crash.   

The defendant had a blood alcohol content level of .19, more than twice the legal limit, according to investigators.  

If convicted as charged, he faces up to six years in prison for the third-degree felony and 180 days behind bars for the DUI and reckless driving charges.
