Lawsuit: New Mexico Police Wrongly Held Beaten Driver

  A New Mexico man is suing a group of New Mexico State Police officers and it all stems from an attack by a motorist that landed him and his wife in the hospital.

The lawsuit filed this month in U.S. District Court in Albuquerque claims Jaime Diaz of Truth or Consequences was wrongly arrested while recovering from his injuries and later lost his job while stuck in jail on charges dismissed twice.

According to a lawsuit, Diaz and his wife were beaten by the motorist following a July 2013 traffic dispute. Court papers say the motorist fled the scene then an officer arrived and threatened to use a stun gun on Diaz.

The lawsuit says police arrested Diaz at a nearby hospital.

A New Mexico State Police spokesman Emmanuel Gutierrez says the department is confident officers will be exonerated.
