Man Found Guilty In Wife's Murder

In State vs Robert Braithwaite the jurors returned guilty verdicts on Aggravated Battery and Aggravated Battery Great Bodily Harm after deliberating for only 55 minutes.

Robert Braithwaite shot his wife of 32 years, Sheila Braithwaite, with a 20 gauge shotgun from a distance of 109 feet on their property in Chaparral, NM on August 30, 2013.

The defendant refused to call for emergency assistance but stepped across her body to get another beer.  Ms. Braithwaite managed to call for help resulting in Doña Ana County Sheriff’s response.

Prosecutors Gerald M. Byers and Sarah Van Cott from the Third Judicial District Attorney’s office argued that the defendant’s alcohol indeed fueled his crime while the defending attorney, Tom Wright, argued that Braithwaite’s actions were unintentional.

Robert Braithwaite was immediately taken into custody pending sentencing within 30 days.
