Las Cruces---A grand jury found that the state’s evidence brought against Joshua Jones warranted a 1st Degree Murder charge along with Attempt to Commit 1st Degree Murder; Attempt to Commit Aggravated Burglary (Deadly Weapon); Conspiracy to Commit Aggravated Burglary and (4) counts of Tampering with Evidence.
On the afternoon of February 14, 2015 emergency services received multiple calls reporting gunfire in the Claude Dove and Delano Drive area. Responding officers located Fernando Molina and his brother Antonio Molina both with gunshot wounds to the abdomen.
Jones, 20, enlisted his friend Christopher Silva, 21, to be the lookout in his plan to steal marijuana from a home on Claude Dove but when Jones jumped over the fence he realized he had entered the wrong residence. Victims Fernando and Antonio Molina had initially chased Jones back over the fence and pursued him. After a physical altercation Jones shot both men.
Fernando Molina was transported to University Medical Center in El Paso, TX but Antonio Molina succumbed to his injuries and died at Memorial Medical Center.
Christopher Silva was also indicted on charges of Attempt to Commit Aggravated Burglary (Deadly Weapon) and Conspiracy to Commit Aggravated Burglary (Deadly Weapon).
