Nachison: New Mexico Bill Is About Discrimination, Not Religious Freedom

Commentary:  Mr. Stewart (Las Cruces Sun News, 1/5/16) has the idea that HB55, the so-called "NM Religious Freedom Act  “...will give protection not discrimination,” Just laughable.  Where is any factual basis for  his claim that “…homosexual individuals have knowingly and purposely…selected Christian businessmen to support their…lifestyle.”  This is false.  Mr. D’Ammassa’s recent column is actually correct.

You say "I don’t advocate discrimination…”.  "The provision of services that does not involve violation of religious freedom should be the norm…”.  The norm, sir?  This is the United States, not the inquisition or some extreme mid-eastern location.  Freedom of religion means for you and me to practice our religion or not in our homes and religious institutions and in places open to the public without being bothered or turned away.  Turning people away based on religion is unconstitutional and untenable.  Your religion does not trump my right to expect delivery of any housing or services offered (pun intended).  Why?

1. The First Amendment to the U.S Constitution

2. The 1963, 64 and 1991 Civil Rights Acts and amendments thereto, among others

3. The Fair Housing Act of 1968.

4. The NM Constitution, Article II, Section 5.

5. The NM Human Rights statute, Section 28-1-7-G2/H, among others

6. Las Cruces municipal code, Section 14.

7. US Supreme Court, various decisions 2003-2015.

I suggest you read the relevant portions of all.  It's good history - real and mostly long standing.  There is lots of additional commentary.  This nation was founded on secular law, of historical necessity.  You are welcome to your view of G-d’s law for yourself.  You cannot hold your religion over mine or any person’s non-belief thereof.   America was founded by those fearing religious persecution.  Sectarian law is theocracy and very unwelcome.
