New Mexico Woman Arrested For Allegedly Giving Marijuana Edibles To Child

A Radium Springs woman faces six felony charges after Doña Ana County Sheriff’s detectives alleged she knowingly gave her 13-year-old daughter candy containing marijuana.

Sylvia A. Rubio, 38, was arrested Tuesday.

According to a criminal complaint, Rubio’s daughter allegedly took marijuana and chocolates containing marijuana to school last November. The school principal, upon learning the child had them in her possession, referred the incident to Child Protective Services.

When detectives questioned Rubio, she said she holds a medical marijuana card, as well as a personal production license. She also said a homeopathic doctor has suggested she give her daughter some medical marijuana in edible form to ease her anxiety.

Rubio told detectives she gave her daughter “gummies” containing THC, the active ingredient in marijuana, in April of last year. She denied giving her daughter chocolate, but said she left the bathroom cabinet where it is kept unlocked.

A drug test conducted on the child confirmed the presence of THC in the girl’s system.

Rubio is charged with two felony counts of child abuse in the third degree, two fourth-degree felony counts of contributing to the delinquency of a minor, and two third-degree felony counts of distribution of marijuana to a minor. She is being held without bond, pending arraignment, at the Doña Ana County Detention Center.
