NM Asks Court For Clarification On Building Codes

New Mexico construction regulators are asking the state Court of Appeals for clarification on which building codes should be enforced as it battles with environmental groups.

The dispute centers on a 2011 decision by the Construction Industries Commission to revamp green building codes that were adopted by former Democrat Gov. Bill Richardson's administration.

The appellate court recently directed the commission to set aside the revamped rules until it fixed a procedural flaw.

In addition to asking the court for clarification, the Albuquerque Journal reports (http://bit.ly/11eDL9L) the commission has decided to fix the flaw by preparing acceptable reasons as to why the revamped codes were adopted.

Environmental groups have accused the Construction Industries Division of running afoul of the court for initially saying it would enforce the revised codes until the commission decided how to carry out the court's ruling.
