Perry's Legal Team To Ask Judge To Dismiss Case Against Him

  An attorney for Republican Texas Gov. Rick Perry says he will file a motion seeking to stop the criminal case against the possible 2016 presidential candidate.

Austin attorney David Botsford said Friday that Perry's defense team will attack the constitutionality of the prosecution and two felony indictments that accuse the governor of abusing his power. A Republican judge presiding over the case gave Botsford a week to file the motion.

The special prosecutor in the case, Michael McCrum, says he remains confident in the charges.

Perry is accused of leveraging his veto power to try to oust a Democratic district attorney whose office oversees the state's Public Integrity Unit. Perry cut off state funds to the unit when Rosemary Lehmberg refused to resign following a drunken driving arrest.
