Las Cruces--Chris Silva pled no contest to conspiracy to commit burglary; a 4th degree felony, in a change of plea hearing before Chief Judge Fernando Macias today in district court.
Judge Macias ordered a pre-sentence report to be completed by the adult probation office prior to rendering sentence. Under the conspiracy charge Silva faces up to a maximum of 18 months.
On February 14, 2015 emergency services received multiple calls reporting gunfire in the Claude Dove and Delano Drive area. Responding officers located Fernando Molina and his brother Antonio Molina both with gunshot wounds to the abdomen.
Jones, 20, enlisted Silva, 21, to be the lookout in his plan to steal marijuana from a home on Claude Dove. Jones jumped over the fence and at some point encountered the Molina brothers who gave chase, a physical altercation ensued in which Jones shot both men.
The state requested a sentence of 1-year for Mr. Silva to which the defense felt a conditional discharge and probation would be appropriate. After reviewing the pre-sentence report Judge Macias will determine sentencing.
A jury trial date for Joshua Jones is yet to be determined.
