A new report says a Las Cruces man recently shot and killing by police was legally drunk and had marijuana in his system when he reportedly pointed an ominous-looking gun at officers.
Atoxicology report says Jose Ramon "Joey" Estrada had the drug in his system when Las Cruces police officers shot him outside his mobile home in July.
In addition, the tests showed that Estrada's blood-alcohol concentration was at least .15, nearly twice the legal limit for drivers.
An autopsy report released last month also said Estrada suffered from schizophrenia.
All three officers involved in Estrada's death were placed on standard administrative leave but returned to work later that month.
