Shoeprints Lead To Burglary Suspect

Las Cruces – Sunday at approximately 12:30 a.m. Dona Ana Sheriff's Deputies responded to the 920 block of Vado Drive, after a woman reported arriving home to her residence and found her home in disarray.

The Victim, age 48, who is employed with the Las Cruces Police Department, stated she heard a noise, a "Rustling" and believing someone was in the residence, ran towards her bedroom locking the door behind her and called 911.

When Sheriff's Deputies arrived on scene, they located a pair of shoe prints directly beneath a window where it was believed entry into the residence was gained.

Sheriff's Deputies followed the pair of shoe prints to a residence approximately one block north of the Victim's residence, which lead up to the doorway and came in contact with the owner of the residence in the 30 block of Elle Mae.

While Sheriff's Deputies were speaking with the owner of the residence, they heard a noise coming from a bedroom and asked permission from the owner, the Suspects mother, to go into the bedroom, where they found an individual hiding in the bathroom.

Subsequent investigation by Sheriff's Investigators revealed that the individual hiding in the bathroom was the same person responsible for the burglary earlier.

The Suspect admitted to Sheriff's Investigators that he and his eight (8) year old brother had gone to the residence earlier, however, before entering the residence, he told his brother to turn around and to go back home and that his brother did not enter the residence with him.

The Suspect admitted to the taking of items, which were later recovered in the same bedroom the Suspect was hiding in, after directing Sheriff's Investigators to those items.

Taken from the residence was electronic equipment and cash.

The Suspect, LUIS L. RUBIO, age 20, was charged by Sheriff's Investigators with one count of Residential Burglary, a third degree felony, one count of Breaking and Entering, one count of Tampering with Evidence and one count of Contributing to the Delinquency of a Minor, all fourth degree felonies.

RUBIO, when arrested, had two outstanding Bench Warrants for his arrest as well.
The Victim, who was alone at the time, was not harmed and remained in her bedroom until Sheriff's Deputies arrived on scene.
