Some Transparency Now Required For Home Owners Associations

Boards and members of local home owners associations (HOAs) need to know that state legislation – known as the Home Owner Association Act – passed earlier this year requires more transparency in fiscal and policy activity and also registration with Doña Ana County.

In partnership with the City of Las Cruces, Sen. Joseph Cervantes and Doña Ana County Clerk Lynn Ellins will discuss the impact of this legislation and the registration process at a meeting beginning at 6 p.m. Tuesday, Nov. 12, in the Auditorium at Doña Ana Community College – East Mesa Branch, 2800 N. Sonoma Ranch Dr.

Senate Bill 497 passed by the New Mexico legislature in early 2013 requires home owners associations to register with the county clerk’s office. The legislation outlines certain other requirements of HOA boards that address accounting procedures and board action subject to public inspection.

The legislation language may be found on the New Mexico Legislature’s website at http://www.nmlegis.gov, through the Bill Finder option at the Legislation link. For more information about the bill or the meeting, contact Jamey Rickman, community liaison for the City of Las Cruces at 575/541-2192.
