State Charges Dropped In Fatal Stabbing

State charges were dropped against two New Mexico prisoners suspected of fatally stabbing another inmate, but the prosecutor's office indicated that the case is going to be filed in federal court.

The Las Cruces Sun-News reports that no federal charges have yet been filed against Jerry Montoya and Jerry Armenta in the 2014 death of 34-year-old Javier Enrique Molina at the Southern New Mexico Correctional Facility.

Molina had been stabbed more than 40 times.

At the time, Montoya had been serving a 17-year sentence for the 2000 shooting death of a teen. Armenta had been serving a three-year sentence for a contributing to the delinquency of a minor conviction.

Molina was serving a 13-year sentence for armed robbery, tampering, escape from jail and forgery stemming from a 2009 incident.
