Teen Brothers Charged With Battering Las Cruces Officers

Las Cruces Police arrested a man suspected of striking three officers and spitting at two of them.

Gabriel Lopez, 18, of the 2500 block of Burke Road in Dona Ana County, is charged with three counts of battery on a peace officer, two counts of assault on a peace officer and one count of obstructing an officer.

At around noon Sunday, Feb. 15, Las Cruces Police were dispatched to the report of an affray near the intersection of Alameda Boulevard and McClure Road. Shortly after police arrived, Lopez became verbally aggressive and began threatening one of the officers. The officer was forced to engage in a physical altercation with Lopez in order to take him into custody.

A short while later, as officers tried to conduct a standard inventory search of Lopez, Lopez tried to head-butt one of the officers. Lopez continued to struggle with three officers and spat at two of them.

The officers were not seriously injured.

Lopez’s 13-year-old brother was also charged with one count of battery on a peace officer after he physically attacked one of the officers who responded to the affray.

Lopez was booked into the Dona Ana County Detention Center with bond set at $4,000.
