Deming – A 19-year-old originally charged with first-degree murder in a 2008 shooting has pleaded guilty to two counts of tampering with evidence in a homicide.
State District Judge Daniel Viramontes on Monday accepted Joshua Tena's pleas.
In exchange, the district attorney dropped the first-degree murder charge that had been filed in the Nov. 6, 2008, shooting death of 15-year-old Luther Garcia.
Tena is to testify against 18-year-old Alvar Aguirre, who was charged last December with first-degree murder and tampering with evidence.
He is accused of shooting Garcia while the three teens were target shooting.
Tena was considered an accessory.
