Las Cruces – An inmate awaiting trial for murder has sued Dona Ana County and its jail, alleging medical negligence left him hospitalized for four weeks.
The county does not comment on pending litigation.
The lawsuit says after 32-year-old James Russell Bogart's March 2008 arrest, doctors saw him for bedsores caused by the wheelchair he uses.
The filing says doctors found wounds and low potassium levels, and told Bogart to follow up with a doctor in two days and use a second mattress to cushion his wounds.
The lawsuit alleges he was denied the mattress for two days while kept in an isolated cell.
It also alleges he also was denied catheters and was forced to use the single one he had when he was arrested, which resulted in a severe urinary infection.
