Las Cruces Area Man Faces Up To Six Years In Prison For Felony Battery Of Officer

  A jury Tuesday found Davalous Brown, 22, guilty on two counts of Battery on a Peace Officer, both felonies, and Resisting, Evading or Obstructing an Officer that could result in 6 years incarceration.

On July 12, 2014, Dona Ana County Sheriff’s Deputy Chase Thouvenell arrived at Brown’s ex-girlfriend’s home acting on a warrant for his arrest in a domestic dispute that had occurred the previous night. Upon exiting the shower Mr. Brown was confronted by the deputy informing him of his arrest.  Brown lunged at the deputy and a fray ensued. Mr. Brown gouged Deputy Thouvenell’s eye, eventually took possession of his taser and pointed it at Thouvenell, forcing him to draw his firearm. Mr. Brown lunged again at the deputy before running out of the house and through the neighborhood causing Deputy Thouvenell to discharge his weapon.

The deputy located a nearby trailer with disturbed skirting consistent with someone sliding under the home. Assistance for the deputy arrived and again Mr. Brown fled causing Deputy Thouvenell and another agent to fire, striking Brown once in the calf. Upon arriving back at the house, Brown barricaded himself and engaged law enforcement in a standoff for several hours. A K-9 officer was placed in the home to confront Brown. At one point Brown attempted to fight the police dog and bit him around the eye.

Following the conviction Mr. Brown was immediately taken into custody.  Chief Judge Fernando Macias delayed sentencing for this conviction pending the outcome of Mr. Brown’s domestic violence case
