Las Cruces Man Indicted In Veteran's Death

Las Cruces – A man charged in a 2008 homicide is expected to go to trial in three months, despite having to go before a grand jury a second time.

Prosecutors in Las Cruces say 32-year-old James Russell Bogart has been re-indicted on charges of first-degree murder and tampering with evidence in the shooting death of his housemate, a former Army Ranger and Iraq War veteran.

The second presentation of the case last week to a Dona Ana County grand jury was ordered by state District Judge Lisa Schultz, who determined jury instructions during the original presentation in April 2008 had been improperly delivered.

On March 15, 2008, 30-year-old Jeremy J. Hernandez had an argument with his wife and was shot at his Las Cruces home, where Bogart had been living.
