Sierra Club Sues Martinez Over Building Codes

New Mexico – The Sierra Club is suing Gov. Susana Martinez before the state Supreme Court after she prevented the publication of building codes intended to promote energy-saving standards.

Martinez issued an executive order shortly after taking office Jan. 1 that suspended all pending and proposed regulations for 90 days while a task force reviews them.

The Sierra Club contends she exceeded her authority by canceling rules finalized by the previous administration.

It also contends the heads of the State Records Center and the Construction Industry Division exceeded their authority by attempting to cancel publication of the rules.

The Sierra Club says the law provides that such rules are considered published anyway if the state fails to publish them as the result of an error.
