Las Cruces---A hearing to modify conditions of release for Tai Chan; ex-Santa Fe County Deputy, was heard by Judge Fernando Macias in the Third Judicial District Court today. A trial date of September 28, 2015 was also set.
Chan’s attorney’s requested that Chan be allowed to return to Santa Fe County, be placed under house arrest with the stipulation of wearing an electronic monitoring ankle bracelet. Chan’s attorney argued that his client was not a flight risk and his proximity to his defense counsel was necessary in order for pre-trial work to be completed.
District Attorney Mark D’Antonio argued that the state agreed with the “No Bond” decision a magistrate court judge made in the fall and did not agree with the $600,000 secured bond that District Court Judge Marci Beyer ordered nor with any of the proposed modifications presented today.
Jeremy Martin’s mother was present and pleaded with the court to deny all of Chan’s requests. Martin’s widow also addressed the court via telephone, pleading for any requests to be denied stating that she was in fear for her family as Chan is a highly trained law enforcement agent.
Judge Macias did grant all modifications. Tai Chan will be returning to Santa Fe County with the following conditions; he will be placed under house arrest, he must wear an electronic ankle bracelet, he may not gain employment and may only attend religious services if proof of a historical past with a particular affiliation is provided to the court. It was also granted that he may have contact with a primary witness in the case, his girlfriend, who is also pregnant with their first child.
