Trial For Las Cruces Murder Suspect Underway

  Dominic Montoya is on trial facing Murder in the First Degree, Possession of a Weapon, and Tampering with Evidence for the murder of fellow inmate Adam Avalos that occurred in April 2006.

The defendant allegedly murdered Mr. Avalos in the shower by using a prison issued razor.

Testimony from the Detention Pod Officer, on duty nurse and medical examiner were heard by the jury today.

Defendant Montoya was and is currently serving a 44 year sentence handed down in 2009 for Armed Robbery, Distribution of Marijuana, Tampering with Evidence, Possession of Firearm and Drug Paraphernalia at the time of Adam Avalos’ death. 

Montoya has prior convictions dating back to 1999 which include Second Degree Murder with Firearm, Attempt to Commit Second Degree Murder with a Firearm and Armed Robbery with a Deadly weapon, all felonies.

If Montoya is convicted for the murder of Adam Avalos he faces more than 30 years in prison.
