UPDATE: Las Cruces Police Being Sued For $12.5 Million

Ross Flynn, 47, is suing the city of Las Cruces for $12.5 million following the incident shown in this video, while he was being detained by Las Cruces Police.  The Las Cruces Police Department states it is conducting an internal investigation and the Third Judicial District Attorney’s Office is also reviewing the incident that occurred Dec. 23 in a holding cell.

The incident involved two LCPD officers and Flynn, who was being booked on charges of aggravated assault with a deadly weapon, assault on a police officer, and resisting or obstructing a police officer. Those charges were related to an incident that occurred on the 1500 block of Foster Road.

In a statement, Las Cruces Police said, once the department learned of the District Attorney’s Office review of the case, the two officers involved in that incident were assigned to administrative duties.

“We learned of this incident in late December and immediately started an internal use-of-force investigation which is still ongoing,” said LCPD Chief Jaime Montoya. “We take all such matters seriously and will conduct a complete and thorough investigation taking in all facts before rendering a decision.”

A release states it is standard operating procedure for the Las Cruces Police Department to review all use-of-force cases.

Because of pending litigation in this case, the Las Cruces Police Department says it cannot comment with specifics until the matter is adjudicated.

Questions concerning the external review of the incident are being directed to the District Attorney’s office.
